21. Subscription and Cancellation
Subscription services automatically renew at the end of each billing period unless you cancel before the renewal date. Cancellations take effect at the end of the current billing period, and you will retain access until that date.

You use our Services at your own risk. Any material downloaded or obtained through our Services is accessed at your own discretion and risk, and you will be solely responsible for any damage to your device or loss of data.
23. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE OUR SERVICES.
Our total liability to you for all claims arising out of or relating to these Terms or our Services shall not exceed the greater of one hundred dollars ($100) or the amount you paid us in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
24. Indemnification
You agree to indemnify, defend, and hold harmless Junk Car Chicago, its affiliates, and their respective directors, officers, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your use of or inability to use our Services
- Your violation of these Terms
- Your violation of any rights of another party
- Your User Content
25. Dispute Resolution and Arbitration
Informal Resolution: Before filing a claim, you agree to contact us at service@junkcarchicago.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email.
Binding Arbitration: If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall be resolved by binding arbitration. The arbitration shall take place in Chicago, Illinois
Class Action Waiver: You and the Junk Car Chicago agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class action, consolidated action, or representative action.
Exceptions: Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Services or intellectual property infringement without first engaging in arbitration.
26. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Illinois, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms (except those subject to arbitration) will be brought exclusively in the federal or state courts located in the State of Illinois, and you consent to personal jurisdiction and venue in such courts.
27. Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately, but the provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
You may terminate your account at any time by contacting us or following the account closure procedure in your account settings.
28. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
29. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Services, constitute the entire agreement between you and Junk Car Chicago regarding your use of our Services and supersede all prior agreements and understandings.
30. Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
31. Assignment
You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.
32. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
